Welcome to MilliHobby! The terms “we”, “us” and “our” refer to MilliHobby. MilliHobby operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). MilliHobby is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province of residence.
You are responsible for maintaining the confidentiality of your account and for all activity under your account.
SECTION 2 - OUR PRODUCTS
We strive to display products as accurately as possible. However, colors and appearance may differ depending on device settings.
We do not guarantee product appearance will match images exactly.
Manufacturer defects only qualify as defects. Cosmetic box condition and manufacturer variance are not defects.
We reserve the right to discontinue or limit quantities at any time.
SECTION 3 - ORDERS
Placing an order constitutes an offer to purchase. Orders are accepted only after payment is processed.
Orders may not be cancelable after acceptance. Cancellation requests may be subject to a cancellation fee of up to 10%.
SECTION 3A - PRE-ORDER PRODUCTS
Certain items sold are pre-orders and are not yet in stock.
Release dates are estimates provided by manufacturers and may change without notice. Delays are common in the collectibles industry and do not qualify for cancellation, refund, or chargeback except where required by law.
All pre-order sales are final once placed.
SECTION 3B - ALLOCATION AND AVAILABILITY
Trading cards and collectibles may be allocated by distributors.
If we receive fewer units than ordered, we may partially fulfill the order and refund the unfulfilled quantity only. Allocation adjustments do not constitute a breach of contract.
SECTION 4 - PRICES AND BILLING
Prices exclude taxes and shipping unless stated.
Some orders use calculated-later shipping. Customers will receive a shipping invoice prior to dispatch and orders will not ship until shipping is paid.
Failure to pay shipping within a reasonable timeframe may result in cancellation subject to fees.
SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates only and not guaranteed.
Risk of loss transfers to the customer once the carrier marks the package as delivered to the address provided at checkout. We are not responsible for stolen packages or incorrect addresses provided by the customer.
COLLECTOR PACKAGING CONDITION
Products sold are collectibles. Packaging condition is not guaranteed mint. Minor dents, shelf wear, or manufacturer imperfections are not defects and not grounds for refund.
TRADING CARD PRODUCTS
All trading card products are final sale once opened. Pull rates, card condition, or contents are not guaranteed.
SECTION 6 - INTELLECTUAL PROPERTY
All content on this site belongs to MilliHobby or its licensors and may not be used without permission.
SECTION 7 - THIRD PARTY TOOLS AND LINKS
We are not responsible for third-party tools or websites linked through our Services.
SECTION 8 - ERRORS AND OMISSIONS
We reserve the right to correct errors, update information, or cancel orders if information is inaccurate at any time.
SECTION 9 - DISCLAIMER OF WARRANTIES
Services and products are provided “as is” without warranties of any kind to the fullest extent permitted by law.
SECTION 10 - LIMITATION OF LIABILITY
MilliHobby shall not be liable for any indirect, incidental, or consequential damages arising from use of the Services or products.
SECTION 11 - INDEMNIFICATION
You agree to indemnify and hold harmless MilliHobby from any claim arising from your breach of these Terms.
SECTION 12 - GOVERNING LAW
These Terms of Service shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
You agree to submit to the exclusive jurisdiction of the courts of British Columbia, Canada.
SECTION 13 - CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Services constitutes acceptance of changes.
